This privacy policy sets out the personal data management rules applied by the companies listed under the “Who collects your data?” section, which are hereinafter referred to collectively as the “ACOEM Group”. This policy applies to data collected by these companies via the following websites, hosted within the European Union: acoemgroup.com, oneprod.com, 01db.com, metravib-defence.com, and metravib.acoemgroup.fr. By using the services offered by these websites, users are deemed to have accepted this privacy policy.

The term “personal data” is used to mean all data serving to identify a physical person, in particular full name, telephone number, date of birth, email address, postal address, IP address, and any other information that users choose to communicate to the ACOEM Group via the websites listed above.

With a view to safeguarding users’ personal data, the ACOEM Group complies with prevailing legislation and, in particular, European Regulation No. 2016/679 of 27 April 2016 relative to the protection of personal data.

This privacy policy may be updated at any time to ensure that we remain compliant with prevailing legislation and also in the event of modifications to our procedures or the operations offered on our website. The “last updated” date at the top of the page will be modified accordingly.

What personal data do we collect and for what purpose?

We collect only the personal data that is strictly necessary in order to process your request.

If the personal data collected by the ACOEM Group is used for commercial prospection purposes, this will be specifically indicated.

We collect your personal data for various purposes.

  • Newsletter

When you choose to subscribe to our newsletter, we will ask you to provide an email address to which the newsletter will be sent.

  • Processing of applications

When you apply for a job vacancy published on our website, or if you wish to submit a spontaneous application, we collect the personal data necessary to consider your application, including your full name, email address, telephone number, curriculum vitae and covering letter. The ACOEM Group does not use any automatic decision-making tools for recruitment purposes.

  • Information requests relating to our products and services

When you submit and information request relating to the products and services offered by the ACOEM Group, we collect certain personal data in order to be able to respond, including your name, email address, post code and, as appropriate, the name of the company that you represent and your telephone number.

  • Quotation requests

This option is available on some of our Websites. When you submit a quotation request, we collect certain personal data in order to be able to contact you with the proposal that is best suited to your requirements, including your name, email address, postal address and, as appropriate, the name of the company that you represent and your telephone number. At the same time as submitting a quotation request, you can also subscribe to our newsletter. This subscription, however, is not mandatory in enabling us to send you a quotation.

  • Demonstration request

This option is available on some of our websites. When you submit a demonstration request, we collect certain personal data in order to be able to contact you to make arrangements for the demonstration or training, including your name, email address, postal address and, as appropriate, the name of the company that you represent and your telephone number. On some of our Websites, you can subscribe to our newsletter at the same time as submitting this request. This subscription, however, is not mandatory in enabling us to respond to your request.

  • Product training request

This option is available on some of our websites. When you submit a product training request, we collect certain personal data in order to be able to contact you to make arrangements for the demonstration or training, including your name, email address, postal address and, as appropriate, the name of the company that you represent and your telephone number. On some of our Websites, you can subscribe to our newsletter at the same time as submitting this request. This subscription, however, is not mandatory in enabling us to respond to your request.

  • Creation of a user account for access to customer services or to submit a support request

This option is available on some of our Websites and enables you to access our customer services or to submit a support request if you already possess one of our products. If you wish to create your user account, you must enter some personal data required for identification purposes, so that you can access certain features and tailored content, as well as your history. The data required is as follows: name, email address, and the name and address of the company that you represent. Depending on the Website in question, we may also ask for your telephone number, your customer reference and the serial number of your equipment.

  • Downloading a white paper

This option is available on some of our Websites and enables you to access practical guides that provide additional information on certain issues that the company you represent may encounter. These white papers are prepared by the ACOEM Group, sometimes in collaboration with other companies or research laboratories. When you download these resources, we will ask you to complete a form requesting certain personal data, including your name and email address.

  • Email prospection campaigns

When creating your user account on some of our Websites, or when you submit a product or services information request, a demonstration request or quotation request, and, more generally, when you provide your email address to the ACOEM Group, we ask you to agree to receive commercial prospection emails from the ACOEM Group by checking the box. If you no longer wish to receive these emails, simply click on the unsubscribe link located at the bottom of every email.

  • Aggregate data

We may use your personal information to generate aggregate data, which does not include any personal data and cannot be used to identify you. Aggregate data may be used for statistical purposes. The ACOEM Group reserves the right to transfer and/or sell aggregate data.

On what legal grounds is the processing of your personal data justified?

The processing of your personal information is justified by your consent and/or is required in order to provide the services that you have requested.

When you complete one of the forms on our Websites, we ask for your consent prior to collecting and processing your personal data.

This consent is granted by means of a check box.

If you do not check this box, we will not be able to use your data for this purpose.

 

How is your data kept secure?

The ACOEM Group undertakes to implement all necessary measures to maintain the integrity and confidentiality of the personal data collected. To this end, the ACOEM Group has implemented appropriate technical measures, such as physically securing its buildings and facilities and ensuring the security of the information system, to prevent any unauthorized third parties from accessing the data.

When it has recourse to subcontractors, the ACOEM Group ensures that its subcontractors also comply with the rules pertaining to the protection of personal data processed on its behalf.

As we all have a part to play in data security, you are responsible for preventing unauthorized third parties gaining access to your online accounts, in particular by implementing a password compliant with the recommendations of the CNIL (French data protection and civil liberties commission) (i.e. comprising at least eight characters and at least three of the four following character types: upper case, lower case, number and special character) and ensuring that you log out when using a shared terminal.

 

Is your data transferred abroad?

Your data may be shared with any of the ACOEM Group’s subsidiaries based abroad in the context of a request for product/service information, a quotation or demonstration, in order to best respond to your expectations, or to circulate your application within the ACOEM Group and thus maximize your chances of success.

Certain of our subsidiaries are located in countries that are not subject to the General Data Protection Regulation (GDPR). Nevertheless, as they belong to a French group, our subsidiaries are aware of the importance of compliance with the legislation pertaining to data protection applicable in Europe.

 

Is your personal data shared with third parties?

Your personal data will be shared with third parties only if the structure of the ACOEM Group is modified in the event of a sale, transfer or merger of the Group or part of the Group, or if the Group acquires or merges with another company. In this case, the ACOEM Group will employ its best efforts to ensure that the other party complies with the applicable legislation pertaining to the protection of your personal data.

 

Links to social networks and other third-party websites

Our Website contains links to other websites and to certain social networks (hereinafter “Third-Party Websites”) that are not managed by the ACOEM Group.

The ACOEM Group manages only its own page on each of these Third-Party Websites, and this page contains a link to the websites covered by this confidentiality policy.

These Third-Party Websites are independent and have no connection with the ACOEM Group. Thus, these Third-Party Websites are responsible for the data that they collect from you and for the confidentiality policy that they apply, which may differ from that of the ACOEM Group.

We do not accept any liability for the practices and confidentiality policies applied by these Third-Party Websites in relation to personal data, and we invite you to familiarize yourself with the confidentiality policies specific to these sites.

 

For how long is your personal data stored?

We comply with the recommendations of the CNIL (French data protection and civil liberties commission). Your data will not be stored for any longer than is legally permitted.

  • If you apply for a job vacancy via the Website or if your send us personal information in the context of a spontaneous application, we will store your data for up to two years from sending. During this time, we reserve the option to contact you again if another vacancy arises corresponding to your profile.
  • If you submit a request for information relating to the products and services offered by the ACOEM Group, we will make a distinction between “customers”, i.e. those who have already made at least one purchase from the ACOEM Group, and “prospects” who have not yet made a purchase. This distinction has an impact on the starting point for the storage period applied to your data:
    • The personal data of prospects will be stored for up to three years from the date of collection.
    • The personal data of customers will be stored for up to three years from the last time that the customer contacted the ACOEM Group.
    • If you subscribe to our newsletter, your personal data will be stored for as long as you maintain the subscription. Your data will be deleted within one month with effect from the day on which you indicate to us that you no longer wish to receive our newsletter.
    • The same applies if you are on a mailing list and receive our prospection emails.

Your personal data may also be stored beyond the above-mentioned durations so far as this is necessary for us to comply with other applicable legal provisions or if we require this data in order to establish, exercise or defend our rights in the event of a complaint or legal action.

 

What are your rights?

You have various rights with regard to your personal data.

Each of these rights is set out in detail below and can be exercised simply by writing to us, either by email at legal@acoem.com or by post at the address set out in the header of this policy.

We will endeavor to respond to your request in a timely manner.

Right to access your personal data

You have the right to know whether your personal data is subject to processing by the ACOEM Group and to what purpose, and, if so, to request a copy.

You can also request a list of any recipients to whom your personal data has or may be transfered.

Right to rectify your personal data

You have the right to request that your personal data be rectified and/or supplemented.

Right of erasure of your personal data

You can request that your personal data be erased at any time. However, such a request may have consequences on the commercial relationship or a recruitment process in progress between you and the ACOEM Group. In the event that the processing of your personal data is legally justified and necessary in order to process a request or application that you have made, an objection to the processing of your data will mean that we cannot pursue the said request or application. All commercial relationships, requests and recruitment processes in progress may therefore be terminated. The implementation of the erasure of your data may be postponed if the performance of a contract between you and the ACOEM Group is already at an advanced stage and if the processing of your personal data is necessary for the completion of this contract.

Right to restrict processing of your personal data

You have the right to request the restriction of the processing of your personal data. This restriction may relate to the data itself, to third parties to whom your data is sent, or the purposes for which your personal data is processed.

In the event that the processing of your personal data is legally justified and necessary in order to process a request that you have made, the restriction of the processing of the said data may prevent us from processing the request in progress or any future requests. All commercial relationships, requests and recruitment processes in progress may therefore be terminated. The implementation of the restriction of the processing of your data may be postponed if the performance of a contract between you and the ACOEM Group is already at an advanced stage and if the processing of your personal data is necessary for the completion of this contract.

Right to portability of your personal data

You have the right to receive a structured document setting out the personal data that we hold, and you have the right to send this document to any third party whatsoever.

Right to object to the processing of your personal data

You have the right to object, at any time, to the processing of your personal data. In the event that the processing of your personal data is legally justified and necessary in order to process a request that you have made, an objection to the processing of the said data may prevent us from processing the request in progress or any future requests. All commercial relationships, requests and recruitment processes in progress may therefore be terminated.
